The modification to work (modificación de autorización de estancia por estudios a autorización de residencia y trabajo) is a legal process that converts a student residence permit into a standard work authorization. It is not a new visa application. Instead, it is an administrative modification to your existing permit, processed in Spain through the immigration office.
The key principle is that if you have lived legally in Spain on a student TIE (Tarjeta de Identidad de Extranjero, your Spanish residence card) for at least three years, passed all the subjects or credits in your final academic year, have not received a public Spanish scholarship during your studies, and have a job offer in Spain related to your qualifications, you may be eligible to modify your status to a work permit.
Under RD 1155/2024, additional modification pathways were introduced for certain students who meet specific conditions before completing three years of study. However, the standard three-year route remains the primary and most clearly defined pathway.
This modification is significant because it allows you to remain in Spain and transition from student status to a work permit without returning to your home country or starting a new visa application from scratch.

The student-to-work modification application requires a complete application file demonstrating that every eligibility criterion has been met. Incomplete application files are one of the leading causes of delays and refusals.

Review your TIE history to confirm you have lived legally in Spain on student permits for at least three years. Obtain your official final degree certificate and your academic transcript for your final year of study. Both documents must confirm that all subjects or credits were completed successfully.
Your job offer is one of the most important parts of the application. You need a signed offer from a Spanish employer for a position that is genuinely related to your field of study. The employer must also be registered with Spain’s Social Security system. A verbal promise or conditional offer is not sufficient.
Gather every required document before submitting. Make sure your degree certificate is the final version (not provisional) and that your academic transcript clearly shows all subjects as passed. Missing or unclear documents commonly result in delays.
Your application must be submitted between 60 days before your student permit expires and 90 days after its expiry. Missing this window usually means following a different legal process, which is considerably more complex.
Once your modification is approved, you will receive an authorization confirming your new residence and work status. You must then book a TIE appointment to obtain your updated residence card. Your first work permit is typically issued for one to two years and can be renewed if you continue to meet the requirements.

You have already done the hard part: studying in Spain, building your life here, and earning your degree. The student-to-work modification is the legal step that allows you to stay and turn that investment into a career in Spain. The timing is precise, and your documents need to be right. The three years must be legal residence in Spain specifically on a student TIE. Brief gaps caused by permit renewal processing do not usually count against you, provided your renewal applications were submitted on time. However, periods spent in Spain without valid student authorization do not count. If your TIE history includes gaps or other complications, we can assess them during your consultation.
If your student permit expires before you complete your studies, you cannot yet apply for the student-to-work modification. You will normally need to renew your student permit to cover your remaining studies. Once you have completed your degree and received your final degree certificate, you can apply during the permitted application window.
Part-time job offers may qualify in some circumstances, provided the position complies with Spanish labour law and is clearly related to your qualifications. A part-time role connected to your degree is generally stronger than a full-time position in an unrelated field. If you submit your application before your student permit expires, you remain legally in Spain while the application is being processed. Your application receipt serves as evidence of your pending status. This is a normal part of the process and does not, by itself, indicate a problem with your application.
No. You cannot legally begin working until your modification has been approved and your work authorization has been granted. Starting employment before approval is a serious immigration breach that may affect both your current application and future immigration matters.
Once approved, you receive a new Spanish TIE showing your residence and work authorization. The initial permit is typically valid for one to two years and may be linked to a specific employer or employment sector, depending on your approval. If you continue to meet the requirements, you can renew your permit before it expires, and after five years of continuous legal residence you may become eligible for long-term residence in Spain.
